Hiring CMT as Independant contractor in Indiana?

I am in the process of expanding my practice to include other therapists (I won't whine about too much business...it's glorious). HOWEVER, One who interviewed with me says the laws of Indiana were changed in the last few years and now you can no longer work full-time as an independent contractor. News to me, but I'm new to Indiana...given the choice between freelancing, hourly or 40/60 split I've always prefered the split...but she seemed adamant that is no longer allowed under Indiana law. A call to the state massage board yielded nothing...does anyone here have insight?

First step is the IRS website for the differences between ICs and Employees
2nd is the IN state board of labor

Part of what you say leads me to think this person is correct -- Full Time. Fulltime is an employment term, not a contractual term.

You have to be very careful when using contractors -- putting anything in writing like "hire" "schedule" or "hours" puts you at risk for treating an employee as a contractor and opens you up to heft penalties and back taxes.

Consult a labor attorney as well before drafing an agreement.

Ok, finally getting back here after a whirlwind of development at the center. Quick update: we now have three therapists, one apprentice, two more in the pipe. Growth is outstanding and I'm very, very tired. You guys really have rocked on the advice, thank you!!!
